65. FORMER STAPLETON ROAD ALLOTMENTS SITE – REVISED TENANCY AGREEMENT
The Committee NOTED a number of amendments to the tenancy agreement proposed by the prospective tenant, some of which the Council’s solicitor had accepted and some of which had been rejected.
It was RESOLVED that:-
1. The Committee would look favourably at a request from the prospective tenant to renew the lease at
the end of the term;
2. The layout of the track and any necessary permissions are the tenant’s responsibility;
3. With regard to schedule 5.3.4 - 48 hours should be the maximum allowed to remove waste or machinery;
4. The Town Council gives no warranty, express or implied, as to the use or ownership of the track 5. Subject to the above the tenancy agreement be finalised as soon as possible

73. TO CONSIDER THE REVISED TENANCY AGREEMENT FOR THE FORMER STAPLETON ROAD ALLOTMENTS SITE
The Committee NOTED a copy of the tenancy agreement as signed by the prospective tenant.
The Committee RESOLVED that the tenancy agreement to be signed and that the prospective tenant be informed that the Council is entering in to the tenancy agreement without any warranty being given, express or implied, that the use of the land is permitted under planning or other legislation and that the onus is on the tenant to ensure that the required permissions are in place

The report of the Clerk was received. It was AGREED that:
Allotment Sites
(i) the allotment fee-scale be reviewed at the Committee meeting on 21st June 2011 (with details of comparable/neighbouring rates being included with the agenda);
(ii) a quote be obtained for clearing the overgrown area of the Allum Lane site for consideration at a future meeting of the Committee (when available);
(iii) a second hand small ride-on-mower be purchased (within Budget), if deemed fit for purpose by Cllr G Franklin and Clerk/Handyman, for use on both Allotment Sites, Council Office verges and Closed Churchyards;
(iv) a brief statement of basic guidelines for allotment users be published by the Council (Clerk to organise);

subject to weather, an allotment site visit take place immediately prior to the next Committee meeting scheduled for 26 July 2011 (Members to meet at Town Council Office Car Park at 6.00 pm);
information be provided for further consideration on the number and amount of concessionary fees provided by the Council to allotment holders;
further quotes be obtained for clearing the overgrown area of the Allum Lane site for consideration at a future meeting of the Committee (when available);
a recommendation be made to Council on 7 September 2011 to authorise the transfer of sufficient funds from General Reserve/mower replacement fund (once amounts were available and agreed by the Committee) to purchase:
New mower for use on all Council sites (Rover 560 Pro Cut – c.£850)
Contractor clearance and new marking of specified allotment plots at Allum Lane site
the allotment fee scale for the forthcoming year (from October 2011) remain at £3.50 per pole and the concessionary fees be maintained (with a review to be undertaken at a future meeting).

The report of the Clerk was received. It was RESOLVED that
(i) following the Committee Site Visit to Allum Lane it was agreed that the cleared plot no. 9 be used as the Council benchmark for plot clearance and that this plot be available for rent with immediate effect at a 50% concessionary rate;
(ii) further consideration on the number and amount of concessionary fees provided by the Council to allotment holders be given at the annual review of rents for the 2012/13 year (the 2011/12 fees having been fixed at the current year’s rate);
(iii) the Clerk be tasked with pursuing the availability of contributory grant funding in order to supplement the cost of clearing plots 20-41 at Allum Lane to the benchmark standard (the principle of returning these plots for allotment use was agreed with wildlife protection being fully taken into account and the agreement to use plots nos.20-22 by a charitable organisation being terminated);
(iv) the Clerk be authorised to approve contractor clearance (to benchmark standard) of the following vacant plots at Allum Lane: 5b, 6b, 10a, 11, 13a and 15a with immediate effect for letting as soon as possible;
(v) plot availability (Allum Lane and Melrose sites) be granted to those on the existing Council waiting list by priority to those persons who were not already plot holders.
(vi) from the start of the new allotment Year (1 October 2011), the combination padlock numbers at both sites be altered with more user friendly padlocks replacing the existing items (tenants to be notified of new combination by way of rent letter).
(vii) the recommendation of the Committee at its previous meeting be reaffirmed; namely to Council on 7 September 2011 to authorise the transfer of sufficient funds from General Reserve/mower replacement fund to purchase:
New mower for use on all Council sites (Rover 560 Pro Cut – £700 - £850); and Contractor clearance and new marking of specified allotment plots at Allum Lane site (less any monies received by way of grant funding).

It was noted that the Contractor works to clear the bottom plots at Allum Lane had been completed (total cost £300) on 17 August 2011 with all of these scheduled to be allocated.
It was RESOLVED that
Allotments
(i) the plot holder of E2 at Melrose Allotments be asked to ensure that the metal container recently erected on site was safely removed with the Council‟s reasons for this decision being fully explained with reference to the tenancy terms and conditions;
